Terms and Conditions

This on-line store Site is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Agreement"). By accessing or using this Site in any manner, you agree to be bound by the Agreement. Please read the Agreement carefully. If you do not accept all of these terms and conditions, please do not use this Site. Be sure to return to this page periodically to review the most current version of the Agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of this Site signifies your acceptance of the updated or modified Agreement.

Use Restrictions

This on-line store Site is primarily intended to facilitate business to business transactions. Although individuals may use this Site to purchase products for their personal use, Ahearn & Soper Inc. will not sell products to persons under the age of 18. By using this site you warrant that you are 18 years of age or older and possess the legal authority to create a binding obligation. Ahearn & Soper Inc. reserves the right to require individual purchasers to validate that they are 18 or older.

This Site is the property of Ahearn & Soper Inc. You may not modify the materials at this Site in any way or reproduce, publicly display, distribute or otherwise use them for any public or commercial purpose. Any use of these materials on any other website or networked computer environment for any purpose is prohibited.

Order Acceptance

Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Ahearn & Soper Inc. reserves the right to accept or decline your order for any reason, at any time after receipt of your order, and prior to delivery. All orders must obtain pre-approval with an acceptable method of payment, usually by means of a credit card authorization. At our sole option, we may require additional verifications or information before accepting any order. Our on-line store accepts orders only in Canadian dollars and for delivery within Canada.

Shipping

Ahearn & Soper Inc. will not make partial shipments against your orders. All items ordered will be shipped at one time using the shipping method selected by you to the shipping address selected by you. Shipping charges are calculated on the actual weight and size of your shipment.

Delivery shall take place and title shall pass to you when items ordered are placed in the possession of a carrier, packed and ready for shipment, at our warehouse facility in Toronto, Ontario. Risk of loss and responsibility for shipping charges shall pass to you on delivery. Delivery to destinations outside of Canada is not available.

Payment

All shipments made as a result of orders placed on this Site must be paid for with a valid credit card. We accept Visa, MasterCard, American Express, Discovery, and Diners Club credit cards. All payments for shipments are processed in Canadian dollars.

Your credit card will not be charged until your order is shipped. However we will attempt to obtain an authorization on your credit card for the amount of your order, at the time your order is processed. This authorization is not a charge but still may utilize a portion of your credit limit or available funds making those funds or portion of your credit limit unavailable for other use. In the unlikely event that your order is delayed or cancelled the authorization will expire and your credit limit or available funds will again become available for use. The amount of time it takes for an authorization to expire is dependant on the policies of the bank that issued your card and ranges from 1 to 7 business days.

Warranty

All products sold by Ahearn & Soper Inc. through this Site come with the manufacturer's new product warranty. In most cases products are warranted by the manufacturer against defects in workmanship and materials for a period of twelve (12) months from the date of shipment, provided that the product remains unmodified and is operated under normal and proper conditions. Product warranties do, however, vary both by manufacturer and by product model. Ahearn & Soper Inc. provides no additional warranty for any product purchased through this site, including the warranty for merchantability and fitness for a particular purpose, but will provide assistance on request to customers who wish to access the manufacturer’s warranty.

Privacy Policy

In the course of creating your account with us or placing an order through this on-line store, you will directly provide us with personal or corporate information, including names, addresses, phone numbers, and email addresses. In addition you will provide us with indirect information about your needs and requirements when you order items from us.

We understand that all of this information is provided to us “in trust”, that is with the expectation that we will take every reasonable step to protect it, and that we will only use it for legitimate purposes. We take our responsibility in this regard very seriously and make it our highest priority to ensure the security and confidentiality of all of the information you provide us with either directly or indirectly.

We will use the information you provide us only for the purposes of processing and supporting your requests to purchase from our on-line store, to facilitate payment, and occasionally to provide you with information about special offers or new products that relate to your purchases. If you place an order through this store, some of the personal or corporate information you provide is transmitted to your credit card company to verify and authorize your purchase. In order to deliver your order, your name, telephone number and shipping address must be provided to our third party shipper. There may also be instances where, in order to expedite your delivery, we will drop-ship your order directly to your shipping address from one of our suppliers. These suppliers will be given your name, shipping address and telephone number for the sole purpose of fulfilling your order To the extent required by law, we will also disclose Personal Information to government authorities or third parties pursuant to a legal request, subpoena or other legal process. We may also use or disclose your information as permitted by law to perform charge verifications, report or collect debts owed, fight fraud or protect our rights or property as well as those of our suppliers or other customers. You should be aware that, following disclosure to any third party, your Personal Information may be accessible by others to the extent permitted or required by applicable law.

Except for the foregoing, we will not share, rent, or sell your information to any third party.

As a registered user of our online store, you have the capability to change or update any information that you have provided to us. You may also decide to delete your account. If you wish us to delete your account and your information please email your request to customerservice@ahearn.com, and provide us with a phone number we can contact to verify your intent.

Security Policy

We employ 128-bit encryption technology in all areas of the Site which require you to provide your personal or account information, including those areas related to online ordering, and order status. The Site utilizes industry-standard firewalls and Secure Sockets Layer (SSL) technology to allow for the encryption of potentially sensitive Personal Information, such as your name, address and credit card number.

You should recognize, however, that no computer system is fully secure and that there are inherent risks associated with Internet transactions. Limitation of Liability

In no event will Ahearn & Soper Inc., its suppliers, or other third parties mentioned at this site be liable for any damages whatsoever (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information or services contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not Ahearn & Soper Inc. has been advised of the possibility of such damages. If your use of the materials, information or services from this site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

Jurisdiction

This Agreement shall be governed by, subject to, and construed according to the laws of the Province of Ontario.
